Terms & Conditions

This page gives an overview of the general way I work and how we'll collaborate on your project. While our specific project agreement will contain the exact details tailored to your needs, these terms serve as the foundation for how I protect your investment and ensure our partnership is a success.

1. The Build & Subscription Model

By entering into a project with me, you are opting into a "Subscription-based Build." This allows you to spread the cost of professional design or redesign with ongoing support over an agreed-upon term (12, 24, 36, or 48 months).

  • Ownership: You retain ownership of any and all brand assets, copy, and images provided by you. Ownership of the final website design is officially transferred to you upon the final payment of your build term. All copyrights and ownerships of the tools used to create or redesign your site remain the property of their respective owners and nothing is transferred to you or me.
  • Early Buyout: Should you wish to own the site outright before the end of your term, you may pay the remaining balance of the build quote at any time.

2. Payments & Delinquency

Reliability is a two-way street. I work hard to keep your site live; I ask that you ensure payments are made on time.

  • 14-Day Grace Period: If a payment is missed, you have a 14-day window to rectify the account.
  • Suspension: If an account remains unpaid after 14 days, the website will be temporarily suspended (taken offline) until the balance is cleared.
  • Cancellation during Build: If you choose to cancel your subscription before the build is paid in full, the website will be removed from the server, and no refunds for previous months will be issued.

3. Care Packages & Maintenance

All builds include the Essentials Package by default during the payment term.

  • Scope of Updates: "Content updates" include modifications to existing text, images, and basic layout adjustments. Major feature additions or substantial site changes will require a separate project quote.
  • Third-Party Licenses: I provide the licenses for my core "Build Stack". Any specialty plugins requested by the client (e.g., specific booking engines or premium membership tools) are the financial responsibility of the client. On completion of the site build, if there's a handover of control you will be responsible for buying licenses for any all plugins or themes to take over from mine. 

4. Liability & Support

I use industry-standard security and backup protocols to protect your site. However, the internet is an ever-evolving landscape.

  • Limitation of Liability: Jack Randall WP is not liable for any loss of revenue, data, customers, or reputational damage resulting from site downtime, server failures, or third-party hacks that are beyond my direct control.
  • Emergency Support: While I systems in place to monitor sites 24/7, active support is provided during business hours (Monday-Friday, 09:00 - 17:00).

5. Moving & Off-boarding

If you choose to manage the site yourself after the build is paid in full:

  • Handover: I will transfer all logins, server access, and applicable licenses to your name.
  • Migration: If you wish to move the site to a different hosting provider, a Migration Fee of $250 applies to cover the technical labor of packaging, moving, and testing the site on a new environment.
